Tym wpisem rozpoczynamy nową serię „na co zwrócić uwagę przy zakupie samochodu”. Zdarzają się sytuacje, że pomimo dochowania wszelkich formalności, skonstruowaniu dobrej umowy sprzedaży (uwaga! Nie ma umowy kupna-sprzedaży ? ), upewnieniu się, że samochód pochodzi z legalnego źródła.. i tak zapukać do naszych drzwi może policja z postanowieniem prokuratora o zatrzymaniu rzeczy. Wtedy pojawia się pytanie co w takiej sytuacji robić? Zanim dokonam analizy co w takiej sytuacji robić (najlepiej skontaktuj się z prawnikiem, ponieważ właśnie mija 7 dniowy termin na złożenie zażalenia.. możesz to zrobić tutaj), przekażę Ci moją wiedzę oraz doświadczenie, jak zabezpieczyć się przez nieuczciwymi handlarzami i po spełnieniu pewnych przesłanek – nabyć samochód w dobrej wierze.

W pierwszej kolejności powinniśmy sprawdzić czy pojazd nie posiada statusu „kradzionego” i nie jest poszukiwany przez organy ścigania.

W wyszukiwarce Google znajdziemy wiele baz, stron, aplikacji, które oferują usługę „sprawdzenia” pojazdu pod kątem zgłoszonych szkód, napraw itp. Jest to opcja płatna, która może być przydatna, gdy jesteśmy bardzo zainteresowani kupnem pojazdu i jesteśmy tuż przed podpisaniem umowy. W sytuacji, gdy jesteśmy potencjalnie zainteresowani zakupem pojazdu i chcemy go tylko sprawdzić, z pomocą przychodzi nam strona historiapojazdu.gov.pl. Jedyne co potrzebujemy to numer rejestracyjny, numer VIN oraz datę pierwszej rejestracji. Data pierwszej rejestracji jest podana w dowodzie rejestracyjnym pod literką B. Taką informację powinien udzielić Ci sprzedający – jeśli oczywiście niczego nie chce ukryć.

Jeśli została zgłoszona kradzież na terytorium Polski, taka informacja powinna pojawić się na historiapojazdu.gov.pl wielkimi literami KRADZIONY. Istnieją również sytuacje, w których zgłoszona została kradzież a pojazd nie widnieje jako kradziony.. jednakże takie sytuacje należą do rzadkości, że dyżurny policji nie wpisze pojazdu do Krajowego Systemu Informacji Policji (KSIP).

Po wpisaniu prawidło danych, powinna wyświetlić się nam nasza historia pojazdu, dotycząca pierwszej rejestracji, zmiany właściciela, okresowego badania technicznego oraz aktualnego stanu drogomierza. Jest to szczególnie ważne w kontekście ewentualnego przestępstwa licznikowego (o cofaniu licznika napisałem odrębny post, który możesz przeczytać tutaj). Jeśli w przeszłości zdarzyła się kradzież pojazdu i zostanie odnaleziony przez właściciela, takie informacje również zostaną odnotowane.

Podsumowując, jeśli po sprawdzeniu samochodu na historiapojazdu.gov.pl nie znajdziemy komunikatu KRADZIONY, taki pojazd nie figuruje w policyjnych bazach jako utracony. Jednakże mogą zdarzyć się sytuacje (znane z doświadczenia i występują bardzo rzadko..), że pomimo formalnego zawiadomienia o kradzieży pojazdu bądź jego utracie, taki pojazd nie figuruje na stronie historiapojazdu.gov.pl, ponieważ nie został wprowadzony do policyjnej bazy Krajowego Systemu Informacji Policji.
