Kontrola droga przez nieumundurowanego policjanta?

Ostatnio na Instagramie otrzymałem pytanie „czy nieumundurowany policjant może zatrzymać mnie do kontroli drogowej? Przecież tak naprawdę może być to jakaś pułapka!”.

Zgodnie z rozporządzeniem Ministra Spraw Wewnętrznych i Administracji z dnia 6 listopada 2019 roku Policjant nieumundurowany jest uprawniony do zatrzymania kierującego pojazdem wyłącznie na obszarze zabudowanym. Ustawodawca w ten sposób ma na celu wyeliminowanie sytuacji, w których na drodze poza obszarem zabudowanym dochodziłoby do zatrzymania pojazdu i stworzenie niebezpiecznej sytuacji.

Policjant nieumundurowany w warunkach dostatecznej widoczności podaje sygnały tarczą do zatrzymywania pojazdów, a w warunkach niedostatecznej widoczności – latarką ze światłem czerwonym albo tarczą do zatrzymywania pojazdów ze światłem odblaskowym lub światłem czerwonym. Warto zaznaczyć, że w tej sytuacji nieumundurowany policjant nie jest uprawniony podać sygnału zatrzymania pojazdu ręką!

Pamiętaj, że polecenie do zatrzymania pojazdu podaje się z dostatecznej odległości, w sposób zapewniający jego dostrzeżenie przez kierującego pojazdem oraz bezpieczne zatrzymanie w miejscu wskazanym przez policjanta.

Policjant, po zatrzymaniu pojazdu, podaje kierującemu stopień, imię i nazwisko oraz przyczynę zatrzymania, a ponadto nieumundurowany policjant okazuje legitymację służbową bez wezwania. Okazują ją w sposób umożliwiający kontrolowanemu uczestnikowi ruchu odczytanie i zanotowanie danych pozwalających na identyfikację policjanta, a w szczególności dotyczących jego stopnia, imienia i nazwiska oraz nazwy organu, który wydał ten dokument.

W przypadku podania przez kontrolującego policjanta polecenia lub sygnału do zatrzymania pojazdu kierujący tym pojazdem zatrzymuje pojazd oraz trzyma ręce na kierownicy. Dodatkowo na polecenie kontrolującego wyłącza silnik pojazdu, włącza światła awaryjne, umożliwia mu dokonanie identyfikacji pojazdu, w szczególności przez udostępnienie komory silnika oraz innych miejsc w pojeździe.
